The relationship between you and your Gestational Carrier is the foundation of your personal surrogacy experience. Developing a clear understanding of your expectations for the relationship and sharing those with your agency and potential surrogate is important. This will help to create mutual respect and understanding for how you move forward. Learning about different surrogacy agencies and deciding which one you would like to work with is an important part of you getting the guidance you need throughout the surrogacy journey. A do-it-yourself approach only adds legal risk and anxiety to an already complex process. Every agency’s approach is different. We recommend choosing a qualified agency that fits your personal requirements and expectations. Consider how the agency pre-screens its potential Surrogate Mothers and whether its services and support offerings are comprehensive. Understand how it will manage insurance coverage and financial transactions, how it will arrange proper legal representation and how much the agency will charge in fees. And never shy away from asking for references and referrals.
The laws governing gestational surrogacy vary by state, country and your specific circumstance. Every Intended Parent will approach the process with their individual needs that will dictate how legal representation should be handled. Having a basic understanding of the current laws governing surrogacy is helpful. Retaining legal representation dedicated to preparing your agreement with your Surrogate Mother, arranging the pre- or post-birth order and proactively protecting your parental rights, is essential.
